Marc McDonald has 20 years of experience practicing before the federal bankruptcy court on behalf of debtors, creditors and bankruptcy trustees. In addition to helping individuals obtain relief from debt, he helps lending institutions and other creditors protect and recover collateral and maximize their recovery during the bankruptcy process. He is regularly retained by bankruptcy trustees to contest fraudulent and preferential transfers and to recover assets for the bankruptcy estate.

Marc has conducted several jury and non jury trials in New Hampshire Superior Courts and the United States District Court for the District of New Hampshire. He represents clients in:

  • Contract disputes
  • Debtor/creditor litigation
  • Construction claims
  • Employment matters
  • Personal injury cases
Marc also has tried numerous adversary proceedings before the bankruptcy court involving issues such as:

  • Whether or not claims such as student loans are dischargeable in bankruptcy;
  • The enforceability and priority of security interests;
  • The effect of constructive and resulting trusts on the bankruptcy Trustee's ability to avoid the transfer of property which otherwise would be available to satisfy the claims of creditors.
As an appellate attorney...
Marc McDonald has briefed or argued over a dozen cases before the New Hampshire Supreme Court in appeals involving various issues including:

  • Insurance coverage issues;
  • The liability of parent companies to provide worker's compensation benefits for an employee of a subsidiary;
  • The enforceability of personal guaranties of bank loans;
  • The effect of dissolution of a partnership on claims held by creditors of the partnership.
He has also argued before the Federal Bankruptcy Appellate Panel.

Prior Experience:
Prior to joining Alfano & Baroff, P.A., Marc was a partner at the firm of Ford, Weaver & McDonald in Portsmouth, New Hampshire.
